INTERNET STORE REGULATIONS

www.flyingdress.cy

§ 1

GENERAL PROVISIONS

The storewww.flyingdress.cyoperates under the principles defined in these Regulations.

The Regulations specify the terms of concluding and terminating Sales Agreements for the Product and the procedure for handling complaints, as well as the types and scope of services provided electronically by the storewww.flyingdress.cythe rules for providing these services, the terms of concluding and terminating agreements for the provision of electronic services.

Every Service Recipient, upon taking steps to use the Electronic Services of the storewww.flyingdress.cyis obliged to comply with the provisions of these Regulations.

In matters not regulated by these Regulations, the following provisions apply:

the Act on Providing Electronic Services of July 18, 2002,

the Consumer Rights Act of May 30, 2014,

the Act on Out-of-Court Consumer Dispute Resolution of September 23, 2016,

the Civil Code of April 23, 1964, and other relevant provisions of Polish law.

 

§ 2

DEFINITIONS CONTAINED IN THE REGULATIONS

ORDER FORM – a form available on the website www.flyingdress.cyallowing the submission of an Order.

CLIENT – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.

CONSUMER – a natural person who performs a legal act with an entrepreneur not directly related to their business or professional activity.

ENTREPRENEUR - a natural person, legal person, and organizational unit not being a legal person, which the law grants legal capacity, conducting business or professional activity in their own name.

PRODUCT/SERVICE – a service available in the store that is the subject of the Sales Agreement between the Client and the Seller.

REGULATIONS - these store regulations.

STORE - the online store of the Service Provider operating at the addresswww.flyingdress.cy 

SELLER, SERVICE PROVIDER – Artstudio Metamorfozy Sp. z o.o.

SALES AGREEMENT – the Sales Agreement for the Product concluded between the Client and the Seller through the Store.

ORDER - the Client's declaration of will constituting an offer to conclude a Sales Agreement for the Product with the Seller.

PRICE – the value expressed in monetary units that the Client is obliged to pay the Seller for the Product.

§ 3

INFORMATION ABOUT PRODUCTS AND THEIR ORDERING

The storewww.flyingdress.cyconducts the sale of Products via the Internet.

The products offered in the store are new, compliant with the contract, and have been legally introduced to the Polish market.

The information on the store's website does not constitute an offer within the meaning of the law. By placing an Order, the Client makes an offer to purchase a specific Product under the conditions specified in its description.

The price of the Product displayed on the store's website is stated in euros (EUR) and includes all components.

Orders can be placed through the website using the Order Form (Storewww.flyingdress.cy) – 24 hours a day throughout the year.

The condition for placing an Order in the Store by the Client is to familiarize themselves with the Regulations and accept its provisions at the time of placing the Order.

 

§ 4

CONCLUSION OF THE SALES AGREEMENT

To conclude a Sales Agreement, it is necessary for the Client to first submit an Order in the manner provided by the Seller, in accordance with § 3 points 5 and 6 of the Regulations.

Upon placing an Order, the Seller promptly confirms its receipt.

The confirmation of the Order receipt referred to in point 2 of this paragraph binds the Client to their Order. Confirmation of the Order receipt occurs through the sending of an email.

The confirmation of the Order receipt includes:

confirmation of all essential elements of the Order,

the withdrawal form,

these Regulations containing information about the right to withdraw from the agreement.

Upon receiving the email mentioned in point 4 of this paragraph, a Sales Agreement is concluded between the Client and the Seller.

Each Sales Agreement will be confirmed by a proof of purchase, which will be attached to the Product.

§ 5

METHODS OF PAYMENT

The Seller provides the following payment methods:

payment by traditional bank transfer to the Seller's bank account,

payment via an electronic payment system.

In the case of payment by traditional bank transfer, the payment should be made to bank account number: 09 1090 0088 0000 0001 5197 0532 (Santander Bank)

In the title of the transfer, please write "Flyingdress session first name and last name of the person ordering the session."

In the case of payment via an electronic payment system, the Client must make the payment before the order is processed. The electronic payment system allows payment via credit card or a quick transfer from selected Polish banks.

The Client is obliged to make the payment for the Sales Agreement within 5 business days from the date of its conclusion, unless the Sales Agreement states otherwise.

The order fulfillment date will be sent only after it has been paid.

§ 6

COST, DEADLINE AND METHODS OF DELIVERY OF THE PRODUCT

 

 

Services purchased in the Store are provided in the area of Cyprus near Cape Greco National Park. If you wish to use the services in other locations, additional charges apply, and their amount is determined at the client's request.

The service price includes picking up Clients from hotels located in the vicinity of the cities of Aiya Napa, Protaras, or Paralimni.

The service completion date is determined in agreement with the Client within 3 days of placing the order.

§ 7

PRODUCT COMPLAINT

Complaint regarding the lack of conformity of the Product with the contract.

The basis and scope of the Seller's liability to the Client who is a Consumer for the lack of conformity of the Product with the contract are defined in the Consumer Rights Act of May 30, 2014.

The basis and scope of the Seller's liability to the Client who is an Entrepreneur, regarding warranty, are defined in the Civil Code of April 23, 1964.

The Seller is liable to the Client who is a Consumer for the lack of conformity of the Product with the contract existing at the time of delivery of the Product and revealed within 2 years from that moment, unless the shelf life of the Product specified by the Seller or persons acting on his behalf is longer.

Notification of the lack of conformity of the Product with the contract and submission of the appropriate request can be made via email to the address:info@flyingdress.cy

In the above message, in written or electronic form, you should provide as much information and circumstances regarding the subject of the complaint, particularly the type and date of the irregularity and contact details. The provided information will significantly facilitate and expedite the Seller's consideration of the complaint.

The Seller will respond to the Client's request promptly, no later than 14 days from the moment the complaint is submitted.

In the case of a complaint by a Client who is a Consumer, failure to address the complaint within 14 days of its submission is equivalent to its acceptance.

In the case of a justified complaint by a Client who is a Consumer, the Seller will refund 100% of the payment, but the client may not use the photographs taken in any way, publish them, or distribute them.

The response to the complaint is provided on paper or another durable medium, e.g., an email or SMS.

 

§ 8

RIGHT OF WITHDRAWAL FROM THE AGREEMENT

Subject to point 10 of this paragraph, a Client who is also a Consumer, who has concluded a distance contract, may withdraw from it without giving reasons by submitting a relevant statement within 14 days.

In the event of withdrawal from the contract, the Sales Agreement is considered not concluded.

The fourteen-day period within which the Consumer may withdraw from the contract is counted for the contract in the performance of which the Consumer (or a third party indicated by him) purchased the service through the website.

The right of withdrawal from a distance contract does not apply to the Consumer if the service is to be performed within a period shorter than 14 days.

The right of withdrawal from the Sales Agreement is granted to both the Seller and the Client in the event of non-performance by the other party of its obligation within a strictly defined deadline.

 

§ 9

TYPE AND SCOPE OF ELECTRONIC SERVICES

The Service Provider enables the use of the Electronic Service, which is the conclusion of Sales Agreements for Services, through the Store.

The provision of Electronic Services to Service Recipients in the Store is carried out under the conditions specified in the Regulations.

The Service Provider has the right to place advertising content on the Store's website. These contents constitute an integral part of the Store and the materials presented therein.

 

§ 10

TERMS OF PROVISION AND CONCLUSION OF AGREEMENTS FOR THE PROVISION OF ELECTRONIC SERVICES

The provision of the Electronic Service specified in § 9 point 1 of the Regulations by the Service Provider is free of charge.

The agreement for the provision of the Electronic Service consisting of enabling the placement of an Order in the Store is concluded for a fixed term and terminates upon the placement of the Order or the cessation of its submission by the Service Recipient.

Technical requirements necessary for cooperation with the IT system used by the Service Provider:

a computer (or mobile device) with Internet access,

access to email,

an internet browser,

enabling Cookies and Javascript in the internet browser.

The Service Recipient is obliged to use the Store in a manner compliant with the law and good practices, taking into account the respect for personal rights and intellectual property rights of third parties.

The Service Recipient is obliged to enter data that is consistent with the actual state.

 

§ 11

COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES

Complaints related to the provision of the Electronic Service through the Store may be submitted by the Service Recipient via email to the address:info@flyingdress.cy

In the above email, please provide as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and expedite the resolution of the complaint by the Service Provider.

The Service Provider will address the complaint immediately, no later than within 14 days from the moment of reporting.

The Service Provider's response regarding the complaint is sent to the email address of the Service Recipient provided in the complaint submission or in another manner specified by the Service Recipient.

§ 12

FINAL PROVISIONS

Contracts concluded via the Store are governed by Polish law.

In the event of any part of the Regulations being inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the contested provision of the Regulations.

Any disputes arising from Sales Agreements between the Store and Consumers will be resolved primarily through negotiation, with the intention of amicably resolving the dispute, taking into account the Act on Out-of-Court Consumer Dispute Resolution. However, if this is not possible or would be unsatisfactory for either party, disputes will be resolved by the competent common court, in accordance with point 4 of this paragraph.

Any disputes arising between the Service Provider and the Service Recipient (Client) who is also a Consumer shall be subject to the competent courts in accordance with the provisions of the Code of Civil Procedure of November 17, 1964.

The Client who is a Consumer also has the right to use out-of-court methods of dispute resolution, in particular by submitting, after the conclusion of the complaint procedure, an application for mediation or an application for the case to be considered by an arbitration court (the application can be downloaded from the websitehttp://www.uokik.gov.pl/download.php?plik=6223). A list of Permanent Consumer Arbitration Courts operating at Provincial Inspectorates of Trade Inspection is available on the website:http://www.uokik.gov.pl/wazne_adresy.php#faq596. The Consumer can also take advantage of free assistance from the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection. Out-of-court claims after the conclusion of the complaint procedure are free of charge.

To amicably resolve the dispute, the Consumer may in particular submit a complaint via the ODR (Online Dispute Resolution) platform, available at the address:http://ec.europa.eu/consumers/odr/.

If you make a transaction without creating an account on our site, we process personal data for no longer than e.g. 2 years from the date of transaction completion;

  2. for data collected to fulfill the obligations of the personal data administrator arising from the provisions of law, i.e.:

    • e.g. to carry out tax settlements - they will be stored for a period of 10 years;

  3. for data collected in connection with the fulfillment of legally justified purposes of the personal data administrator, i.e.:

    • potential pursuit of civil law claims and defense against such claims - they will be stored for a period of 5 years.

    • consideration of complaints - for a period of 5 years.

 

Legal basis for personal data processing

  1. The legal basis for the processing of your personal data is:

  1. art. 6 para. 1 lit. c GDPR(necessity to fulfill legal obligations incumbent on the administrator, arising from EU law or Polish law) - in the scope of point 3 lit. b of the clause;

  2. art. 6 para. 1 lit. f GDPR(necessity of processing for purposes arising from the legally justified interests pursued by the administrator, i.e. pursuing, establishing and defending against claims, establishing conflicts of interest - in the scope of point 3 lit. c of the clause.

 

  1. Providing data is:

  1. voluntary, but necessary to conclude and execute the contract, which forms the basis for the purchase of goods or services offered on the website WWW (…) ;

  2. voluntary, but necessary to provide marketing services based on granted consent.

 

Transfer of personal data

  1. The administrator does not anticipate transferring your personal data to another recipient with the following exceptions:

a) entities providing IT, accounting, hosting services for the administrator, in the scope of handling electronic payments;

b) postal and courier companies;

c) legal advisors, attorneys, trainee legal advisors and attorneys cooperating with the Administrator.

 

Rights

  1. Based on and subject to the limitations arising from Articles 15-22 of the GDPR, you have the right to:

  1. access your data and receive a copy thereof;

  2. correct (amend) your personal data;

  3. restrict the processing of personal data;

  4. delete personal data;

  5. transfer data;

  6. object to processing.

You can exercise these rights at the headquarters of the personal data administrator, by correspondence, via electronic communication means, or by phone.

 

  1. If you believe that the processing of your personal data by the personal data administrator violates the law, you can exercise your right to lodge a complaint with the President of the Office for Personal Data Protection. The complaint is free of charge.

 

  1. In order to better tailor our products and services to customer requirements, your personal data will be subject to automated decision-making, including profiling as referred to in Article 22(1) and (4) of the GDPR.

This process will involve the automated processing of your personal data. As part of this processing, we use your personal data to analyze:

  • shopping preferences and

  • interests.

The analysis is conducted by our systems based on previous purchases and products liked on our website. As a result of this analysis, upon logging into the website, automatically tailored suggestions regarding the goods or services we offer will be displayed, which are intended to be aligned with your preferences and interests.

 

As a result, we may acquire information regarding your shopping preferences and interests.

 

You have the full right to object to the profiling described above, in accordance with point 8 below.
