ONLINE STORE REGULATIONS

www.flyingdress.cy

§ 1

GENERAL PROVISIONS

The www.flyingdress.cy Store operates on the principles specified in these Regulations.

The Regulations specify the conditions for concluding and terminating Product Sales Agreements and the complaint procedure, as well as the types and scope of services provided electronically by the www.flyingdress.cy Store, the principles for providing these services, the conditions for concluding and terminating agreements for the provision of services electronically.

Each Service Recipient is obliged to comply with the provisions of these Regulations upon taking action to use the Electronic Services of the www.flyingdress.cy Store.

In matters not regulated in these Regulations, the provisions of:

the Act on the provision of services by electronic means of 18 July 2002,

the Act on consumer rights of 30 May 2014,

the Act on out-of-court resolution of consumer disputes of 23 September 2016,

the Civil Code of 23 April 1964 and other relevant provisions of Polish law shall apply.

 

§ 2

DEFINITIONS INCLUDED IN THE REGULATIONS

ORDER FORM – a form available on the website www. flyingdress.cy enabling the placement of an Order.

CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.

CONSUMER – a natural person who performs a legal act with the entrepreneur that is not directly related to their business or professional activity.

ENTREPRENEUR – a natural person, legal person and an organizational unit that is not a legal person, to whom the law grants legal capacity, conducting business or professional activity on their own behalf.

PRODUCT/SERVICE – a service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

REGULATIONS – these regulations of the Store.

SHOP - Online Store of the Service Provider operating at www.flyingdress.cy

SELLER, SERVICE PROVIDER - Artstudio Metamorfozy Sp. z o.o.

SALES AGREEMENT - Product Sales Agreement concluded between the Customer and the Seller via the Store.

ORDER - Customer's declaration of intent constituting an offer to conclude a Product Sales Agreement with the Seller.

PRICE - value expressed in monetary units, which the Customer is obliged to pay to the Seller for the Product.

§ 3

INFORMATION ON PRODUCTS AND ORDERING

The www.flyingdress.cy Store sells Products via the Internet.

The Products offered in the Store are new, in accordance with the agreement and have been legally introduced to the Polish market.

The information on the Store's websites does not constitute an offer within the meaning of the law. By placing an Order, the Customer makes an offer to buy a specific Product on the terms specified in its description.

The price of the Product displayed on the Store's website is given in euro (EUR) and includes all components.

Orders can be placed via the website using the Order Form (www.flyingdress.cy Store) - 24 hours a day, all year round.

The condition for placing an Order in the Store by the Customer is to read the Regulations and accept their provisions at the time of placing the Order.

 

§ 4

CONCLUSION OF A SALES AGREEMENT

To conclude a Sales Agreement, it is necessary for the Customer to place an Order in advance in a manner provided by the Seller, in accordance with § 3 points 5 and 6 of the Regulations.

After placing the Order, the Seller shall immediately confirm its receipt.

Confirmation of acceptance of the Order referred to in point 2 of this paragraph binds the Customer with their Order. Confirmation of receipt of the Order is made by sending an e-mail message.

Confirmation of receipt of the Order includes:

confirmation of all essential elements of the Order,

a withdrawal form from the agreement,

these Regulations containing instructions on the right to withdraw from the agreement.

Upon receipt by the Customer of the e-mail message referred to in point 4 of this paragraph, a Sales Agreement is concluded between the Customer and the Seller.

Each Sales Agreement will be confirmed by a proof of purchase, which will be attached to the Product.

§ 5

PAYMENT METHODS

The Seller provides the following payment methods:

payment by traditional transfer to the Seller's bank account,

payment via an electronic payment system.

In the case of payment by traditional transfer, the payment should be made to the bank account number: 09 1090 0088 0000 0001 5197 0532 (Bank Santander)

In the title of the transfer, enter "Flyingdress Session, first and last name of the person ordering the session".

In the case of payment via an electronic payment system, the Customer makes the payment before the Order begins to be processed. The electronic payment system allows payment by credit card or quick transfer from selected Polish banks.

The Customer is obliged to pay the price under the Sales Agreement within 5 business days from the date of its conclusion, unless the Sales Agreement provides otherwise.

The order fulfillment date will only be sent once the order has been paid for.

§ 6

COST, DELIVERY TIME AND METHODS OF PRODUCT DELIVERY

Services purchased in the Store are performed in Cyprus in the vicinity of Cape Greco National Park. In the event of a desire to use services in other locations, additional fees apply, and their amount is determined at the customer's request.

The price of the service includes the collection of Customers from hotels located in the vicinity of the cities of Aiya Napa, Protaras or Paralimni.

The deadline for the completion of the service is determined in agreement with the Customer within 3 day

 

§ 7

PRODUCT COMPLAINT

Complaint regarding the lack of conformity of the Product with the contract.

The basis and scope of the Seller's liability towards the Customer who is a Consumer for the lack of conformity of the Product with the contract are specified in the Consumer Rights Act of 30 May 2014,

the basis and scope of the Seller's liability towards the Customer who is an Entrepreneur, under the warranty are specified in the Civil Code Act of 23 April 1964,

The Seller is liable towards the Customer who is a Consumer for the lack of conformity of the Product with the contract existing at the time of delivery of the Product and disclosed within 2 years from that time, unless the expiry date of the Product specified by the Seller or persons acting on his behalf is longer,

notification of the lack of conformity of the Product with the contract and submission of an appropriate request can be made via e-mail to the address: info@flyingdress.cy

in the above message in writing or electronically, as much information and circumstances concerning the subject of the complaint should be provided as possible, in particular the type and date of occurrence of the irregularity and contact details. The information provided will significantly facilitate and speed up the consideration of the complaint by the Seller,

The Seller will respond to the Customer's request immediately, no later than within 14 days from the date of filing the complaint,

in the case of a complaint from a Customer who is a Consumer - failure to consider the complaint within 14 days from its filing is tantamount to its acceptance,

in connection with a justified complaint from a Customer who is a Consumer, the Seller will appropriately refund 100% of the payment, however, the customer may not use the photos taken in any way, publish them or distribute them.

§ 8

RIGHT OF WITHDRAWAL FROM THE CONTRACT

Subject to point 10 of this paragraph, a Customer who is also a Consumer who has concluded a distance contract may withdraw from it without giving reasons by submitting an appropriate declaration within 14 days.

In the event of withdrawal from the contract, the Sales Agreement is considered not to have been concluded.

The fourteen-day period within which the Consumer may withdraw from the contract is counted for the contract in the performance of which the Consumer (or a third party indicated by him) purchased the service through the party.

The right to withdraw from a distance contract does not apply to the Consumer in the event that the performance of the service falls within a period shorter than 14 days.

The right to withdraw from the Sales Agreement applies to both the Seller and the Customer in the event of the other party's failure to fulfill its obligation to the contract within a strictly specified period.

 

§ 9

TYPE AND SCOPE OF ELECTRONIC SERVICES

The Service Provider enables the use of the Electronic Service through the Store, which is the conclusion of Service Sale Agreements.

The provision of the Electronic Service to Service Recipients in the Store takes place on the terms specified in the Regulations.

The Service Provider has the right to place advertising content on the Store's website. This content constitutes an integral part of the Store and the materials presented therein.

 

§ 10

TERMS OF PROVIDING AND CONCLUDING AGREEMENTS FOR THE PROVISION OF ELECTRONIC SERVICES

The provision of the Electronic Service specified in § 9 item 1 of the Regulations by the Service Provider is free of charge.

The Agreement for the provision of the Electronic Service consisting in enabling the placement of an Order in the Store is concluded for a fixed period and is terminated at the moment of placing an Order or ceasing to place it by the Service Recipient.

Technical requirements necessary for cooperation with the IT system used by the Service Provider:

computer (or mobile device) with access to the Internet,

access to e-mail,

Internet browser,

enabling Cookies and Javascript in the Internet browser.

The Service Recipient is obliged to use the Store in a manner consistent with the law and good customs, taking into account respect for personal rights and intellectual property rights of third parties.

The Service Recipient is obliged to enter data consistent with the factual state.

 

§ 11

COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES

Complaints related to the provision of Electronic Services via the Store may be submitted by the Service Recipient via e-mail to the following address: info@flyingdress.cy

In the above e-mail message, provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and speed up the consideration of the complaint by the Service Provider.

The complaint will be considered by the Service Provider immediately, no later than within 14 days from the date of submission.

The Service Provider's response to the complaint is sent to the Service Recipient's e-mail address provided in the complaint notification or in another manner provided by the Service Recipient

§ 12

FINAL PROVISIONS

Agreements concluded through the Store are concluded in accordance with Polish law.

In the event of any inconsistency of any part of the Regulations with applicable law, the relevant provisions of Polish law shall apply instead of the disputed provision of the Regulations.

All disputes arising from Sales Agreements between the Store and Consumers shall be resolved first through negotiations, with the intention of amicably resolving the dispute, taking into account the Act on the out-of-court resolution of consumer disputes. However, if this is not possible or is unsatisfactory for either party, the disputes shall be resolved by a competent common court, in accordance with point 4 of this paragraph.

Any disputes arising between the Service Provider and the Service Recipient (Customer) who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of 17 November 1964.

A Customer who is a Consumer also has the right to use out-of-court methods of resolving disputes, in particular by submitting, after the complaint procedure is completed, an application to initiate mediation or an application for consideration of the case by an arbitration court (the application can be downloaded from the website http://www.uokik.gov.pl/download.php?plik=6223). The list of Permanent Consumer Arbitration Courts operating at the Voivodship Inspectorates of the Trade Inspection is available on the website: http://www.uokik.gov.pl/wazne_adresy.php#faq596. The consumer may also use free assistance from the district (municipal) consumer advocate or a social organization whose statutory tasks include consumer protection. Extrajudicial redress after the complaint procedure is completed is free of charge.

In order to amicably resolve the dispute, the consumer may, in particular, file a complaint via the ODR (Online Dispute Resolution) internet platform, available at : http://ec.europa.eu/consumers/odr/.

Purposes of personal data processing

3. Your personal data are processed:

a. For purposes related to the conclusion and proper performance of the contract, which is the basis for the purchase of goods or services offered on the website at www.flyingdress.cy;

b. in order to fulfill the obligations of the personal data administrator resulting from the provisions of law, i.e. making tax settlements;

to submit to inspections carried out by public entities (e.g. inspections carried out by tax authorities, inspections of the National Labor Inspectorate,

c.  in connection with the implementation of legally justified purposes of the personal data administrator, which are e.g.: pursuing civil claims and defending against such claims.

 

The period of storage of personal data

  1. Your data will be stored for no longer than is necessary for the purposes for which the data is processed, namely:

  1. for data collected for purposes related to the conclusion and proper performance of the contract, which is the basis for the purchase of goods or services offered on the website WWW.FLYINGDRESS.CY, e.g. they will be stored for no longer than 2 years from the liquidation of the account created on our website. In the event that you make a transaction without creating an account on our website, we process personal data for no longer than e.g. 2 years from the date of completion of the transaction;

  2. for data collected in order to fulfil the personal data controller’s obligations arising from legal provisions, i.e.:

    • e.g. making tax settlements – they will be stored for a period of 10 years;

  3. for data collected in connection with the implementation of legally justified purposes of the personal data controller, i.e.:

    • possible pursuit of civil claims and defense against such claims – they will be stored for a period of 5 years.

    • consideration of complaints – for a period of 5 years.

 

Basics of personal data processing

  1. The legal basis for processing your personal data is:

  1. Article 6(1)(c) of the GDPR (necessity to fulfil the legal obligations incumbent on the controller under EU or Polish law) – within the scope of point 3(b) of the clause;

  2. art. 6 ust. 1 lit. f RODO (the necessity of processing for the purposes of the legitimate interests pursued by the controller, i.e. pursuing, determining and defending against claims, determining conflicts of interest – within the scope of point 3 letter c of the clause.

 

  1. Providing your data is:

  1. voluntary, but necessary for the conclusion and performance of the contract which constitutes the basis for the purchase of goods or services offered on the website (...);

  2. voluntary, but necessary to provide marketing services based on consent.

 

Transfer of personal data

  1. The Administrator does not intend to transfer your personal data to another recipient with the following exceptions::

a) entities providing the administrator with IT, accounting, hosting and electronic payment services;

b)postal and courier companies;

c) legal advisers, attorneys, legal adviser and attorney trainees cooperating with the Administrator.

 

Right

  1. Based on and subject to the limitations of Articles 15-22 of the GDPR, you have the right to:

  1. the right to access your data and receive a copy thereof;

  2. the right to rectify (correct) your personal data;

  4. the right to restrict the processing of personal data;

  5. the right to data portability;

  6. the right to object to processing.

You can exercise these rights at the office of the Personal Data Administrator, by correspondence, by electronic means of communication or by telephone.

 

  1. If you believe that the processing of your personal data by the Data Administrator violates the law, you may exercise your right to file a complaint with the President of the Personal Data Protection Office. A complaint is free of charge.

 

  1. In order to better tailor our products and services to customer requirements, your personal data will be subject to automated decision-making, including profiling, as referred to in Article 22, paragraphs 1 and 4 of the GDPR.

    This process will involve automated processing of your personal data. As part of such processing, we use your personal data to analyze:

  • shopping preferences and

  • interests.

The analysis is performed by our systems based on previously made purchases and products liked on our site. As a result of this analysis, after logging in to the website, automatically selected suggestions will be displayed regarding the goods or services we offer, which are supposed to be tailored to your preferences and interests.

 

As a result, we may obtain information about your shopping preferences and interests.
